Terms of Service
Etapano Terms of Service
1. Who runs the service
Etapano, available at etapano.com and app.etapano.com, is run by Mariusz Fituła, a private individual, address: ul. Armii Krajowej 7/45, 67-200 Głogów, Poland, email: etapanomf@gmail.com.
These terms set out the rules for using the service and are provided free of charge in a form that allows them to be saved and printed.
2. What Etapano does
Etapano builds sightseeing plans for cities: it selects places, orders them sensibly, computes walking or travel time between them and checks that the plan fits within opening hours.
The service offers:
- ready plans for selected cities — no account needed,
- plans for any European city — after creating an account,
- saving and editing your own trip plans,
- information about attractions, opening hours and places to eat.
The service is free. We charge nothing for any feature and will not change that without notice and an updated version of these terms.
3. What you need
A device with internet access and a browser supporting JavaScript and cookies. Creating an account requires a working email address.
4. Your account
You create an account yourself using an email address and a password. We send a confirmation link to that address. Until you confirm it, you cannot save trips or plans.
Your password must be at least eight characters. You are responsible for keeping it confidential. If you suspect someone knows it, change it — changing the password invalidates all active sessions.
You can delete your account at any time, without giving a reason. Deleting the account removes all saved trips and plans. This cannot be undone.
Accounts left unconfirmed for seven days may be removed.
5. Where the data comes from, and what that means
This is the most important part of these terms.
Information about places, opening hours and restaurants comes from OpenStreetMap and Wikidata — open databases maintained by volunteers. Routes are computed by the Valhalla engine on our server; public transport connections come from the Transitous service.
This means that:
- opening hours may be out of date — a venue may have changed them without anyone updating the source database,
- some places have no hours listed — the plan says so explicitly,
- travel times are estimates — they do not account for traffic, delays, roadworks or queues at the entrance,
- a place may be closed due to renovation, a holiday, an event or a decision by its operator.
A plan is a suggestion, not a guarantee. Before setting off, check opening hours and availability for the places that matter to you — especially where tickets, travel or bookings are involved.
6. Affiliate links
The service contains links to partners where you can book accommodation or other travel services. If you use such an offer, we receive a commission from the partner. The price you pay stays the same.
Commission does not influence which places appear in a plan or in what order. Plans are built by an algorithm based on how well known a place is, its location and its opening hours — never on whether someone paid us.
You make the booking with the partner, on their terms. We are not a party to that contract and are not responsible for its performance.
7. What is not allowed
When using the service you must not:
- create accounts using other people's email addresses or impersonate anyone,
- extract data by automated means without our consent,
- circumvent security measures or request limits,
- overload the service or interfere with its operation,
- use the service for unlawful purposes.
If these rules are broken we may block or delete the account, notifying the registered email address.
8. Our liability
The service is free and provided as is. We make every effort to keep it working and the data current, but we do not guarantee uninterrupted availability or the accuracy of data obtained from external sources.
We are not liable for damage arising from reliance on a plan — including sightseeing you were unable to complete, tickets that went unused or travel plans that had to change. This does not limit our liability to the extent it cannot be limited under applicable law, in particular for damage caused intentionally.
The service may be temporarily unavailable, including for maintenance, and may be discontinued. If we plan to discontinue it, we will give at least thirty days' notice to the email address you registered with, so that you can save your plans.
9. Complaints
Send comments and complaints to etapanomf@gmail.com. Describe the issue and include the email address linked to your account, if you have one.
We reply within fourteen days of receiving the message, to the address it was sent from.
If you are a consumer, you may use out-of-court complaint procedures, including the EU online dispute resolution platform at ec.europa.eu/consumers/odr.
10. Personal data
How we handle personal data, including the information required by the GDPR, is described in our separate Privacy Policy, which forms an integral part of these terms.
11. Intellectual property
The layout of the service, its design, texts and the way plans are presented are protected by law. Place data comes from OpenStreetMap, available under the Open Database License, and from Wikidata, available under the Creative Commons CC0 licence.
You may use generated plans for your own purposes. Publishing them in full as your own content requires our consent.
12. Changes to these terms
We may change these terms, in particular when the scope of the service, the law or the way the service works changes. We will announce changes on the site and — if you have an account — by email, at least fourteen days in advance.
If you do not accept the changes, you may delete your account before they take effect. Continuing to use the service after that date means you accept the new version.
13. Final provisions
Matters not covered here are governed by Polish law, in particular the Civil Code and the Act on Providing Services by Electronic Means. This does not limit consumer rights under the mandatory law of your country of residence.
If any provision of these terms proves invalid, the remaining provisions stay in force.
